In recognition of employees’ efforts in system restoration during the April 11, 2011 Storm, the Company has made the decision to pay employees directly involved in the restoration time and a half (or the appropriate overtime rate) for all hours worked in support of the restoration.  Everyone has worked a lot of hours so let's continue to focus on safety so that we may all go home to our families when this is over.

Negotiation Bulletin

 

IBEW Local 69 and Oncor Negotiating Committees met on January 26-28th in Arlington, Texas in an effort to reach settlement on a new labor Agreement.

Unresolved issues include the length of the contract, the amount of the wage increase in each year, the FSR wage plan and the treatment of certain work groups in Dallas, Texas.

On Friday afternoon (1/28/11) the Union submitted an offer to the Company for a 2 year contract for a 2% wage increase in the first year and a 2.5% wage increase in the second year (Oct. 2011) with a transition plan to move the FSR’s from a merit pay plan to a step pay plan.

The parties are scheduled to get back together on Wednesday, February 2nd in Arlington, Texas to see if a settlement can be reached.

Here is an update after the meetings this week.  We were able to get close on the remaining grievance issues.   In our view these moves are contingent on other economic issues.  As for economics we were able to move them off the 1 year offer to make an offer for 3 years at 2% 2010-2.4% 2011-and 2% 2012 with the same group being frozen as their previous offer.  They are standing on the  19.42 for FSR's but with no cuts in FSR's over that amount.

The jobs that they propose to freeze were the Service Division, Mechanics, Field Disp., Dist Spec Sr., Network Spec Sr., Cable Pulling SR and Equipment Operator.  We do not have plans to accept this.

I also wanted to let you know that we have Rick Levy intervening in the Oncor rate case.  This does not mean we are against the rate case, it just gives us options by openings up discovery questions  we could not get answered through negotiations.  We will be meeting again next week the 18th, 19th and 20th.  We will  have mediator Dave Renfro there.

November has a been busy month, we are in continued negotiations with Oncor, we held Noel Garcia,s arbitration, also dealt with no paychecks last week due to a input error from the company outsourced to take care of payroll at Oncor and Luminant, approximately 3000 employees were affected. All should have there money by now, but it made for a wild day. As for negotiations we are still moving forward, we had the BM from Local 738 T.J. Burrows and an Fsr from his group Cory Joslyn come and sit in for an afternoon to describe how their duties are similar to our FSR,s we believe it helped and thank TJ and Cory for their time. We will be back meeting the first week in December and will have Federal mediator Dave Renfro with us for a day. I would like to pass on  a special thanks to Brother Bobby Reed for his continued work with our broadcast brothers and sisters. Again we ask for your prayers and patience as we continue working on getting a new contract with Oncor. I hope that you all have a great Thanksgiving Holiday.

For the past three weeks, we have continued our negotiations at full speed. Although we are not finished, we have made some progress. Some of the issues we have agreed upon include a new grievance procedure, addition of MLK Day as a holiday, a new employee orientation, shift exchange for Troublemen, and a new line of progression for storekeepers. Additional items have also been discussed and these will be explained soon. Also, we are still working on the FSR line of progression and wages. 
 Contrarily, the company proposed a one year offer with a two percent salary increase. We are countering all those proposals and will share the results with you as they become available.

The meetings will resume on Nov. 15 due to scheduling issues on both sides.

We just ended our second week of negotiations. We worked out a expedited Grievance Procedure and agreed to a Steward Recognition clause, an accident investigation clause, Resolution action committee, Schedule exchange, 401K issue over Company match withdraw.

We started our second week of negotiation today. We spent most of last week working on contract interpretations. We have a tentative agreement on Benefits Task Force memo, New Employee Orientation, and are close on several issues such as a new streamlined Grievance Procedure.

INFORMATION BULLETIN

 It’s been almost a month since the FSR’s voted to be covered by the Labor Agreement between IBEW Local Union 69 and Oncor Electric Delivery.  Since that time, a number of workplace issues involving FSR’s have been discussed and worked out between the Union and the Company.  Listed below are other significant items being addressed between the Union and the Company.

·                     On June 8th, Union Stewards and FSR Supervisors attended a joint training program in FTW to become familiar with each other’s duties and responsibilities in working together to resolve workplace issues.

·                     On June 22nd, Union and Company representatives will hold the first Wage and Compensation Survey Committee meeting in Arlington.  The purpose of  this Committee is to survey other Utility Companies to determine what type of work their FSR’s perform and at what wage structure. This process will help both Union and Company representatives to develop an appropriate pay plan for the FSR’s during the upcoming contract negotiations, in October.

·                     The Union has requested the following information from Oncor to help determine future Job Security issues involving FSR’s:

 1.       A copy of the Impact Study regarding Smart Meter installation and it’s affect on future FSR work.

2.       A list of all contractors performing FSR work at Oncor.

Dear Union Member

 Congratulations go out to you and your fellow FSR union members who recently joined IBEW Local Union 69 and participated in the Contract Ratification process.  You’re now covered under the Collective Bargaining Agreement between IBEW Local Union 69 and Oncor Electric Delivery. 

 In addition to a number of immediate protections provided by the Contract, bargaining unit employees are now covered by a real and legitimate grievance and arbitration procedure.  This procedure allows employees to settle their job related issues in a fair and timely manner.

 The Union and the Company have scheduled Supervisor and Union Steward training for June 8th at the West DOC facility in Fort Worth.  The purpose of this meeting will be to help Supervisors and Union Stewards understand their duties and responsibilities in dealing with each other over work related issues.

In addition, the Union and the Company will be assembling a Joint Compensation Committee in the near future to begin work on surveying regional electric utility companies to determine the wage rates and job duties of FSR workers around the State of Texas.  The parties will then use that information to put together a step pay plan to be considered during Contract Negotiations in October, 2010.

NEGOTIATIONS BULLETIN

Negotiating Committees for IBEW and Oncor met in Arlington, Texas on March 4th and 5th to continue bargaining on the inclusion of the FSR workgroup into the existing contract between IBEW Local 69 and Oncor that already covers several hundred distribution workers. The existing contract runs through October 25, 2010. 

Annual Merit Pay announcements are being made across the Oncor system to be implemented with the March 15th pay period.  Federal law requires employers under the “status quo” provision to continue granting regular scheduled pay increases while negotiating with a newly certified union representative.  The wage adjustments being made by Oncor range anywhere between 0% & 3.9%, depending on how your supervisor rated you.  The overall average increase granted was slightly below 2%. 

During last week’s negotiation session Oncor submitted a counter-proposal to the Union’s original wage proposal (see below).  The Union has rejected the Company’s proposal and plans to submit another wage proposal at the next bargaining session on March 25th and 26th.

NEGOTIATIONS BULLETIN

Negotiating Committees for IBEW and Oncor met in Arlington on January 28th and 29th, and exchanged lists of issues that each side felt were important to discuss during negotiations to include the FSR workgroup into the existing labor agreement covering the distribution workers.

 Agreement was reached on two (2) issues: 

1)        Conversion to a bi-weekly pay plan for FSRs.

2)        Incorporation of the National Labor Relations Board certification into the labor agreement officially recognizing the FSRs as part of the contract.

Productive discussion also took place over other important issues including wages, hours of work, job security and the impact of PUC regulations on work assignments.  Negotiations between IBEW and Oncor will continue in Arlington on February 18th and 19th.

Two (2) other developments that relate to contract negotiations are:

1)        The Revenue Security Reps have submitted sufficient evidence to warrant a joint meeting with IBEW (George Crawford) and Oncor (Kyle Davis) to discuss the merits of union representation and have an opportunity to cast a secret ballot vote for or against at the end of the meeting, which is scheduled for February 10th in Grand Prairie.

2)        The FSR SRs  have submitted sufficient evidence to warrant a series of joint meetings with IBEW (George Crawford) and Oncor (Kyle Davis) to discuss the merits of union representation and have an opportunity to cast a secret ballot vote for or against at the end of each meeting.  If the FSR SRs vote to no longer be represented by the Union, negotiations will continue to move forward for the FSR workgroup only.  The FSR SR meetings are scheduled for February 10th (Grand Prairie), February 11th (Athens) and February 12th (Brownwood).

Dear Brother and Sisters:
 
On January 15, 2010, the FSR/FSR, Sr.'s, Negotiating Committee met at our IBEW 7th District Office in Arlington, Texas, to discuss the upcoming negotiations with Oncor.  Our International Representative, George Crawford, covered many subjects at this meeting.  We learned that there are many areas that need improvement.  We had a good response from the survey that was sent out to the FSR/FSR,Sr's.  The information received back from the surveys were addressed and this will be help us in our negotiations for the FSR/FSR,Sr.'s.  The first scheduled negotiation meeting with the Company is set for January 28 and 29, 2010.
 
We are currently in talks with the Company to settle some or all of the five grievances that are pending arbitration.  These grievances have been put on hold pending a resolution.  They were discussed at all of our Unit Meetings.  We will keep you updated by informing the stewards on any progress.
 
We have a grievance that is going to arbitration about Cross Utilization with KDFW.  We are currently meeting with an attorney on this issue.

You Succeeded in Getting Your Election

The IBEW has filed your petition for an election.

 

This has been a long and tedious campaign; we started this campaign in 2007.  There have been many ups and downs along the way but you stuck together and stood strong through it all.  Over the last two years many of our supporters left the FSR ranks to take other positions within the company and some left the company entirely for jobs elsewhere. However, most of their replacements recognized the need for representation and stepped forward in supporting our attempt to gain IBEW representation for all the FSRs and FSR SRs.

On Saturday, August 22, 2009, IBEW Local 69 Officers and Stewards met with Seventh District Vice President Jonothan Gardner and International Representative George Crawford at the Dallas Local Union Hall.  The meeting was scheduled to discuss what our Union is doing correct and what we need to improve on.  I would like to thank the following officers, stewards and members for taking their time Saturday to attend the meeting:  Russell C. Fontenot, Greg Germany, Keith Hudson, Mark Hudson, Charlie Jackson, Ron Killion, Mark Lane, Marvin Lawry, Manfred McCollum, Randy McMullen, Bobby Reed, Lynn Riggs, Don Smith, Scott Smith and Jody Taylor. 

We discussed many different issues related to work and our Union .  The membership wants to know what the status of the IBEW Nat’l Healthcare Plan is.  I.R. George Crawford reported that the IBEW submitted a proposal to ONCOR & Luminant several weeks ago.  Luminant has taken the lead on the healthcare issue and has assured IBEW that the Company’s response to the Union proposal should be delivered to the IBEW within a couple of weeks. The Union leadership will then evaluate the Company’s offer and determine if it is reasonable enough to bring back to the Union membership for review and approval to move forward.

We went on to discuss our grievance procedure.  Several of the Stewards were frustrated about how long the grievance procedure takes.  I explained that most of the delays begin when the grievances get to Bonner, Carter and Chapman’s level.  Scheduling grievance meetings with the Directors has been a challenge.   

At the end of the day we came up with a “Union To Do List”. 

1.      Give more advance notice of Unit Meetings, dates, and locations. 

2.      Stewards have mini information meetings at each Service Center.

3.      Grievance communications between Stewards and Business Manager.

4.      Better use of  our web-site

5.      Cross Region exposure of Union representatives.

6.      Schedule future Steward Training at the Dallas Union Hall.

7.      Focus on trouble areas.

8.      Enforce grievance timelines. 

These are some of the things we will be working on in the future. 

We sent a letter to Oncor on 8-17-09 with an answer to their proposal on the Aloi arbitration award and expect a reply the week of 8-24-09. It has been almost 60 days since the award and it is time to get it finalized. Our next step would be to go back to the Arbitrator for his interpretation of the award.

The IBEW Local 69 FR Committee met with Oncor today (5/4/09) to discuss the changes made to the Safety Handbook regarding the Suitable Clothing rule. The FR sock and the FR face shield was the main topic.

The IBEW Local 69 FR Committee sent a letter of our concerns to the ONCOR Arc Flash Committee on 2-6-09.  Our main concerns were on using the FR sock and the FR face shield. We believe that our concerns were considered in making these changes. Please review the attachments and always refer to Safety Rule 107-Suitable Clothing.

A brief summary of what went down at our meeting with ONCOR (Rob Trimble, Brenda Pulis and Kyle Davis) yesterday:
 
·                    Meeting format seemed to be better with smaller group and more candor between the parties.
·                    Parties agreed to focus on improving “communications” and in fact decided to put communication as standing agenda item at each quarterly meeting.
·                    Agreed to begin regular meetings between three (3) ONCOR Regional Managers and Local 69 Assistant Business Managers to improve communications  and address issues at local regional level.
·      ;               Agreed to schedule follow up meetings with Kyle Davis (ONCOR) and George Crawford (IBEW) addressing supervisors and stewards in the different regions.
·                    Discussed and reviewed the possibility of a settlement of an important pending arbitration case involving “rest time”.
·                    Discussed and reviewed the possibility of using “Grievance Mediation” as an additional step to use between a top level grievance and=2 0arbitration.
·                    Discussed and reviewed union concerns over the erosion of bargaining unit jobs and the lack of growth of bargaining unit jobs vs. non-bargaining unit and management jobs.  This issue will also be a standing item on the agenda at the IBEW/ONCOR quarterly meeting.
·                    Agreed to request that the ONCOR Regional Managers work with the Union Assistant Business Managers in their respective regions to complete the updating of the seniority list for bargaining unit employees.
·                    Set the next joint quarterly meeting for August 5, 2009 at 1:00 p.m. at the ONCOR office in Grand Prairie, Texas.

Health Insurance Update

IBEW and Oncor have been in the process of gathering important documents in relation to providing us with a firm bid of IBEW Health care plan. This information has been submitted to the IBEW in Washington and there will be processed and hopefully a bid will be presented here within the next month or so.  Local 69 has pressed very hard on getting this very important issue completed. Brothers,

We have met with the company on the changing of the way we do our on call. We met on 3-30-09 and 4-03-09 and voiced our concerns on why the Company does not have the right to implement this change. We did not come to a conclusion and the Company said that they were going forward with the change. At this meeting we also discussed the grievance procedure and we will be filing a grievance at each service that is affected. This will allow us to see how many service centers are affected and then we will combine them into one grievance. This will be filed under, for the good of the Union.

We are set to have a meeting March 13,2009  for an IBEW representative to make a presentation regarding a cost proposal, etc for the IBEW Healthcare Plan for workers at ONCOR and Luminant. There will be a update to the out come of the meeting.

 IBEW Healthcare update.

IBEW is in the process of getting three bids together to present to EFH.The first bid will be for ONCOR Only. The second bid will be for Luminant Only. The third bid will be for ONCOR and Luminant together.As I understand this you will need to be a bargaining unit employee to participate.We should know something by the end of this quarter about the bids.

 Dear Brother’s & Sister’s: 

On December 10th we held our quarterly Labor/Management Meeting in Arlington, Texas.  This included the Staffing, Safety & Health Care.

The Staffing Committee discussed the job positing that are being put on Oncor’s job posting site.  Oncor plans are to hire 57 new employees and replace 37 employees that have either retired, been promoted or left the bargaining unit for any reason.  This includes an additional storeroom employee in Temple, and two Troublemen – one for each Doc’s. 

On the Safety Committee we discussed the new F.R. clothing that everyone has been fitted for.  Mr. Tidwell did say that instead of the face shield you could wear the head sock and safety glass’s (clear) at night.  You can wear the sock to replace the shield anytime.  Mr. Tidwell also said that 97% of the time the long sleeve Henley will be the only shirt required.  After you receive your new F.R. clothing in January you will no longer be able to wear your current F.R. clothing to work in.  All of these changes have been brought about by the N.E.S.C. - National Electric Safety Code.  There are not any changes to OSHA rules. 

On the healthcare issue there has not been any progress.  The IBEW and Oncor representatives are still getting all data together.  We should know in the first quarter of 2009 if we have a deal or not.

We will be filling vacancies on the E-Board in January.  Anyone that is interested should contact our office by e-mail (ibewloc69@aol.com) or phone (214-821-4700).  These vacancies will be filled on January 22, 2009 at the Dallas meeting.  All E-Board meetings will be held on the 4th Tuesday of the month at 4:00 p.m.  All E-Board members will need to be available by phone at this time.  We will be handling the E-Board business by conference call.  Conference calls will allow everyone an opportunity to serve where they are located at.

To help both the Local 69 and Oncor in gathering a complete seniority list, a form has been created for each and everyone of us to fill out and give to our Supervisor. The Supervisor's are aware of this form and have been instructed to work with us in this process.

With the cooperation in both the Union and Management, we can complete this task in a timely manor.

Brothers and Sisters today May 7, 2008, the Union and company had our quarterly meetings that are spelled out in the labor contrct.The first meeting was regarding safety. (Article X section 3 page 42.) The Union safety committe was I.O. Rep. George Crawford, Scott Smith, Greg Germany, Charlie Jackson, Monty Makarwich, Mark Lane, Gary Mayo, and Bart Powell. The company committee was Reggie Bonner, Mike Carter, Rick Chapman, Kyle Davis, Ashleigh Trimble, Leslie Tidwell, and Jim Reynolds.
Topics of discussion were as follows:
1. The lack of phase sticks for the work force.
2. The primary area meetings. When one needs to wear rubber gloves. Company position is cradle to cradle.
3. Discussion on outrigger sensors being bypassed in tight alleys so outriggers can be put down in tight spots.
4. Discussion on the need for dispatchers to get in contact with customers before sending employees to address on single lights out after hours.
5. Discussion on feeders becoming energized while employees are shooting trouble during storms without warning.
6. Not enough different sizes of rubber gloves in stock.
7. Discussion on if employees need to wear rubber gloves while skinning wire if neither end is terminated. company said they would get answer.
 
In the afternoon the two parties met to discuss Benefits.(Article X section 19. page 51.)
Union Committee was George Crawford Scott Smith, Greg Germany, Charlie Jackson, Monty Makarwich, Gary Mayo, and Gary Mosher. The company committee was the same minus Leslie and Jim (the safety reps) The Topic of discussion was the IBEW National Health care plan. Both parties are looking at all the options. There was also discussion on the Union Veba money. I cannot be more specific on the issues I was unable to attend the meetings because I am in Salado, Tx. for our monthly Unit meeting. Brothers and Sisters,

 

    We concluded our "Contract Language Clarification" meeting today in Fort Worth, Texas. Union Representatives attending the meeting were I. O. Rep. George Crawford, Scott Smith, Greg Germany, Monty Makarwich, and Bobby Reed. Company Reps. Rick Champan, Mike Carter, Reggie Bonner, Ashleigh Trimble, (HR) and Kyle Davis (HR).
    We began the meeting discussing a recent vehicle accident that occurred in the Eastern Region where two employees were injured when the truck they were in flipped numerous times. One of the employees was feeling pressured to show up to work so this would not be a lost time accident. Mr. Chapman assured us that this was not the case, that the employees well being comes first and he would keep us updated on this matter.
    The next issue discussed was the Serviceman issue in Brownwood and Stephenville TX. The Union contends the Company does not have the right to make "wholesale moves" the way they did in Brownwood and Stephenville by transferring the servicemen from the service trucks to line trucks and replacing the servicemen on the service trucks with Journeyman linemen. The Company contends this was done for training purposes and they have always moved those employees around when needed. The company supplied the union with documentation that shows movement between the trucks, but we have not had an opportunity to review the information with Paul Foster or Mark Hudson.
    The next topic for discussion was Rest Time. The two parties disagree on the interpretation of the rest time language. The company maintains the last two hours of the window do not count toward rest time if you are not called out and work into the last two hours. The Union's position is if we are called out to work before the two hours prior to our start time then called back in the two hour window immediately prior to your regular shift the two hours before the beginning of the shift would count toward rest time. The first time this happens we need to file a grievance! Please keep good notes and keep our office advised.
    Next, was the four day ten hour work week language the company has been working on. During negotiations everyone overlooked the fact there were people working 4-10's. The company has language that will accommodate these employees. We are still waiting.
    Discussions then went to the recent storms and how the company has handled these storms. The Union requested their storm restoration manual and they directed us how to go online and get it.
    Our Storeroom employees was the next issue. The Union wanted to know when we were going to get a response to our request foe information regarding the storeroom employees dated February 27, 2008. Ashleigh Trimble stated she had the raw data and was waiting for the managers to look it over and she would have it to us by the end of this week.  The company stated there were no storekeepers 1, 2, or 3's everybody was 4 and up. They also stated they were looking at movement for employees to be moved to the Storekeeper Sr. position. After we receive the information from the company we will review the info. and relay to confirm. It was stated that it is becoming a great burden on these employees covering more than one service center. Kyle Davis stated that pay for storeroom employees in the Utility Industry is very high. The Union knows how valuable the storeroom employees are and will continue to fight for higher wages.
    The Union and Company did agree on something, we agreed to work together to create an accurate seniority list.
    We then discussed fraud protection reimbursement for certain employees. We can discuss this at our unit meetings.
    Finally, last but not least we discussed upgrade pay. The company has now stated that if a Journeyman is to receive upgrade pay of $3.00 an hour they will be informed before leaving the service center in the morning.
    This is the best I could do at summing everything up, yes I know it was lengthy there was a lot said. Greg, Scott, and Monty did a good job today representing everyone. The main thing we learned today is we have a lot of work to do. Let's work together and keep each other informed. Whatever we are having the most trouble with the next three years will be at the top of the list when we meet to negotiate our next contract.

The first quarterly Executive Level Labor/Management Team meeting was held in Dallas, Texas on Monday, February 25, 2008.  Attending were:

ONCOR’s CEO, Bob Shapard, was scheduled to attend, however, he was called away to an out-of-state meeting.

The team reviewed and discussed the following topics:

·                    Update on ONCOR’s first Board of Directors meeting held last week in Dallas.

·                    Update on commitments made at November, 2007 meeting between IBEW, ONCOR and the new owners – Energy Future Holdings:

o       Completed negotiations on a new labor agreement in January, 2008.

o       Establishment of three (3) labor/management teams (General, Safety & Benefits) within the provisions of the new labor agreement to provide more cooperation and collaboration between the Union and the Company on important workplace issues.

o       Agreed to schedule a series of joint union steward/foreman-supervisor meetings to discuss and review key labor/management duties and responsibilities.  These meetings will be led by George Crawford, IBEW and Kyle Davis, ONCOR.

o       Agreed to establish a set of Labor/Management Principles to help guide the Union and Company representatives in developing mutual cooperation and trust.

o       Agreed to schedule a meeting between the Union and the Company to review the “contracting of work” plans and procedures.

The team also discussed some high level topics that will be addressed at future quarterly meetings.  The topics include:

·                    ONCOR’s rate case to be filed this year with the Texas Public Utility Commission.

·                    IBEW’s National Health Care Plan

·                    The 2009 Texas Legislative Session in Austin, Texas.

·                    IBEW’s new Code of Excellence program for Utilities.

·                    Skilled Linemen shortages and the aging workforce issue.

The Union and Company representatives are committed to developing a better working relationship and intend for this renewed focus to be communicated and applied in all local workplaces.

International Labor Organization Finds

National Labor Relations Board Definition of Supervisors

Violates Freedom of Association Principles Decision

The AFL-CIO reports that the International Labor Organization (ILO) has declared that a recent National Labor Relations Board (NLRB) decision that workers can be considered “supervisors” (and denied union rights) if they spend a small portion of their work time per day exercising authority over other workers, violates international labor principles. 

The ILO is a United Nations agency dedicated to strengthening the rights of workers worldwide.  It’s decisions are made on a tripartite basis among government, employer and worker representatives.  Since it’s creation more than 50 years ago, the Committee on Freedom of Association (a branch of the ILO) has examined over 2,300 cases involving violations of internationally accepted workers’ right. 

The ILO released its decision in March holding that the NLRB’s recent interpretation of the term “supervisor” appears to give rise to an overly wide definition of supervisory staff that would go beyond freedom of association principles by excluding such workers from the protections of the National Labor Relations Act (NLRA).  The ILO issued its decision in response to the AFL-CIO’s complaint that the NLRB’s decisions in the Oakwood Trilogy violate principles of freedom of association that bind the United States by virtue of its membership in the ILO.

AFL-CIO President John Sweeney welcomed the decision.  “The Bush-dominated NLRB has taken every opportunity to arm U.S. employers with the tools to defeat the attempt of workers to gain a voice at work.  The ILO’s decision in this case vindicates workers’ rights of freedom of association and collective bargaining, despite attempts at spinning it by U.S. employers.  We will continue to expose shameful conduct of the U.S. government in every forum available to us as we seek to strengthen the ability to form and join unions.”
